WEB STORE TERMS AND CONDITIONS

The owner of the online store StoneHands (hereinafter referred to as the Web Store) is Merkaba Soundhealing Ltd (registry code 14052288)

Validity of Sales Contract, Product and Price Information: These Terms and Conditions apply when purchasing goods from the Web Store. The prices of the products sold in the online store are indicated next to the products. In addition to the price, a fee for the delivery of the goods is added. All prices for goods sold in the online store are in euros.

The delivery fee depends on the buyer's location and the method of delivery. The delivery fee is displayed to the buyer when placing the order. Information about the product is presented directly next to the product in the Web Store.

Order Placement: To place an order, the merchant must follow the solution for making purchases in their online store. To order goods, add the desired products to the shopping cart. To complete the order, fill in the required fields and select a suitable method of delivery for the products. The screen will then display the amount to be paid, which can be securely paid through the following payment methods:

  • Estonian Bank Payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Pocopay

Payment is processed by Maksekeskus AS. Payment takes place outside the Web Store in a secure environment - when paying with a bank link, in the secure environment of the respective bank, and when paying with a credit card, in the secure environment of Maksekeskus AS. The seller does not have access to the customer's bank and credit card data. The contract enters into force upon receipt of the amount due to the Web Store's current account.

The owner of the online store is the data controller and transmits the necessary personal data for payments to the authorized processor Maksekeskus AS.

If the ordered goods cannot be delivered due to the end of the product or for any other reason, the buyer will be notified as soon as possible, and the paid money (including the cost of delivering the goods) will be refunded immediately but no later than 14 days from the date of sending the notice.

Delivery: Goods are shipped to the following countries: Europe. The buyer has the following options for receiving the goods: DPD, Itella, Omniva, e-mail, and picking up in person. The buyer bears the cost of shipping, and the relevant price information is displayed next to the shipping method. In Estonia, shipments generally reach the destination specified by the buyer within 7 working days from the entry into force of the sales contract. Outside Estonia, delivery takes place within 20 calendar days. In exceptional cases, the right to deliver the goods may be exercised for up to 45 calendar days.

Right of Withdrawal: After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days. NB! Depending on the products, the buyer may not have the right of withdrawal; specific products and services must be listed, and they must meet the conditions listed in § 53 (4) of the Law of Obligations Act. The right of withdrawal does not apply if the buyer is a legal person.To exercise the 14-day right of withdrawal, the ordered goods must not be used in a way other than necessary to ascertain the nature, characteristics, and functioning of the goods in the same way it would be allowed to test the goods in a physical store. If the goods have been used for purposes other than necessary to ascertain the nature, characteristics, and functioning of the goods, or if there are signs of use or wear, the Web Store has the right to reduce the amount to be refunded in proportion to the decrease in the value of the goods. To return the goods, the buyer must submit a declaration of withdrawal from the purchase, the form of which can be found here: withdrawal form, and send it to the e-mail address merkabasoundhealing@gmail.com within 14 days of receiving the goods. The buyer must return the goods within 14 days from the submission of the declaration of withdrawal or provide evidence that they have handed over the goods to the carrier within the said period. Upon receipt of the returned goods, the Web Store will immediately, but not later than 14 days after receiving the withdrawal declaration, refund all fees received from the buyer under the contract. The Web Store may refuse to make refunds until the item that is the subject of the contract has been returned or until the buyer has provided evidence of returning the item, depending on which occurs first. If the buyer has explicitly chosen a method of delivering the item other than the cheapest usual method of delivering the item offered by the Web Store, the Web Store is not required to refund the consumer for the cost exceeding the cost related to the usual method of delivering the item. The Web Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store has been significantly misstated due to an error.

Complaints: The Web Store is responsible for the non-compliance or defects of the goods sold to the buyer, which already existed at the time of delivery of the item and which occur within two years, starting from the delivery of the item to the buyer. Within the first year of delivery of the item to the buyer, it is presumed that the defect existed at the time of delivery of the item. Rebutting this presumption is the responsibility of the Web Store. The buyer has the right to contact the Web Store within two months at the latest, by sending an e-mail to merkabasoundhealing@gmail.com The Web Store is not responsible for defects that occur after the goods have been delivered to the buyer. If the goods sold by the Web Store have defects for which the Web Store is responsible, the Web Store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Web Store will refund the buyer all fees associated with the sales contract. The Web Store responds in writing or in a form that allows a written reply to the consumer's complaint within 15 days.

Direct Marketing and Processing of Personal Data: The Web Store uses the personal data entered by the buyer only for processing the order and delivering the goods to the buyer. The Web Store forwards personal data to the transport service providers to deliver the goods. The Web Store sends newsletters and offers to the buyer's e-mail address only if the buyer has expressed a wish to receive them by entering the e-mail address on the website and has indicated their desire to receive direct mail notifications. The buyer can opt-out of offers and newsletters sent to the e-mail address at any time by notifying us by e-mail or by following the instructions in an e-mail containing an offer.

Dispute Resolution: If the buyer has complaints about the Web Store, they must be sent to merkabasoundhealing@gmail.com 

If the online store cannot resolve a dispute through negotiation, the buyer has the option to turn to the Consumer Disputes Committee. The procedural terms can be reviewed, and a complaint can be submitted here. The Consumer Disputes Committee has the authority to resolve disputes arising from agreements between the buyer and the online store. The examination of the buyer's complaint by the committee is free of charge. The buyer may also contact the European Union's platform for resolving consumer disputes.
